[I]t is… offences constituting carnal intercourse against the order of nature… that [form] the substance of this article. It will be shown that although Section 377 [of the Penal Code] purports or was intended to cover all unnatural offences (being the residue of sexual offences commonly perpetrated, other than rape, incest and sexual molestation), an unfortunate lacuna exists in, what appears to be, the common interpretation of this provision.
